Terms of service

Last updated [date]

The short version

  • Beer Appear lets you order and pay from your phone, then pick up at the bar. The bar is the one selling you the drinks.
  • You must be of legal drinking age, and the bar may check your ID or refuse service.
  • Once you've paid, your order goes to the bar. Refunds are up to the bar.
  • A tab puts a hold on your card and is charged when it closes. If you leave it open, the bar's settings close it for you, with a tip.

About these terms

These terms are an agreement between you and [company legal name] ("Beer Appear", "we", "us") for using the Beer Appear apps, web app and website. By creating an account or placing an order, you agree to them. Our privacy policy explains how we handle your information.

These terms are for guests. Bars that use Beer Appear agree to the bar agreement, which covers fees, payouts and running a venue, and their staff agree to the staff terms.

What Beer Appear does

Beer Appear is a platform that connects you with bars. When you order, you're buying from the bar, not from Beer Appear. The bar sets its menu and prices, makes and serves your order, and is responsible for what it serves, including checking your age. Payment goes to the bar through Stripe, and Beer Appear receives a fee from the bar.

Who can use Beer Appear

  • You must be of legal drinking age where you are ordering, and able to enter a binding agreement.
  • The bar may ask for ID when you pick up your order, and may refuse to serve you, for example if you can't show ID or have had enough to drink. If the bar cancels a paid order, it refunds you.

Your account

  • Give accurate details, and keep your password to yourself. You're responsible for orders placed from your account.
  • Tell us straight away if you think someone else is using your account.
  • Staff accounts are for running a bar and can't place orders. A bartender account works at one bar only.
  • You can delete your account at any time in the app, under Account › Delete account.

Ordering and paying

  • Prices are set by the bar and shown before you pay, along with any tax and the tip you choose.
  • Your order is placed when your payment goes through. Until then, you can cancel it and change your order.
  • Once the bar has your order, you can't cancel it in the app. Ask a member of staff. Refunds are up to the bar, and go back to the card you paid with.
  • Tips are shared among the bar's staff according to the bar's tip policy.
  • A bar may pause app orders, or run out of an item, at any time.

Tabs

Some bars let you open a tab instead of paying for each round.

  • When you open a tab, the bar places a hold on your card. The bar shows you the terms before you open it.
  • Each tab has a spending limit set by the bar. When you reach it, you'll need to close the tab or pay for rounds separately.
  • You're charged once, when the tab closes, for all your rounds plus the tip you choose.
  • If you don't close your tab, the bar closes it for you after a period without new rounds, or at closing time, depending on the bar's settings. It then adds the bar's standard tab tip, shown to you before you open the tab. Staff can also close a tab.
  • If the final charge doesn't go through, the bar may contact you to settle it.

Drink responsibly

Please drink responsibly, and never drink and drive. The bar has the final say on whether to serve you.

Using Beer Appear fairly

You agree not to:

  • place orders you don't intend to pay for or collect, or send orders to a bar you're not at;
  • tamper with, copy or move Beer Appear tags;
  • use someone else's account or payment details without permission;
  • interfere with the service, get around its limits or security, or access it with bots or scrapers;
  • use it for anything unlawful.

We may suspend or close accounts that break these terms.

Our service

We work to keep Beer Appear running, but it may sometimes be unavailable, for example during maintenance or if your connection drops. We may change or stop features.

The Beer Appear apps, name, logo and designs belong to us. You may use the apps to order for your own, non-commercial use.

Liability

[To be written by a lawyer for your jurisdiction. It usually covers: the service is provided "as is"; Beer Appear isn't responsible for the bar's products or service; a cap on liability; and a statement that nothing limits rights you have under consumer law that can't be excluded.]

Disputes and governing law

If something goes wrong with an order, talk to the bar first, since it's the seller. If you have a problem with Beer Appear itself, email us at [support email]. We'll try to sort it out.

These terms are governed by the laws of [jurisdiction]. [Courts or dispute resolution process.]

Changes to these terms

If we change these terms, we'll update the date at the top. If a change is significant, we'll let you know in the app or by email before it takes effect. If you keep using Beer Appear after that, the new terms apply.
