Bar agreement
Version 2026-10-07 · Last updated [date]
The short version
- Your bar sells the drinks. Beer Appear provides the ordering, payment and bar station software.
- Guests pay your bar through your own Stripe account. Beer Appear's fee is 2% of each payment, not counting tips, taken automatically. Refunds return our fee too.
- App ordering is only for nights when your bar IDs everyone at the door and nobody under the drinking age is inside.
- You're responsible for your licence, your prices and tax, your refunds and chargebacks, and paying out tips to your staff.
- There's no minimum term. Either of us can end this agreement at any time.
About this agreement
This agreement is between the business that runs your bar ("you", "the bar") and [company legal name] ("Beer Appear", "we", "us"). It covers your bar's use of Beer Appear: the apps, the web dashboard, the bar stations (the iPads, tablets or computers behind the bar that show orders) and the NFC tags.
It starts when an owner accepts it in Beer Appear, either when creating the bar or when asked to in the app. By accepting, that person confirms they're allowed to agree to it for the bar. If you run more than one bar on Beer Appear, it applies to each one.
Everyone on your staff, owners included, also agrees to the staff terms, which cover their own accounts. Guests agree to our terms of service. Our privacy policy explains how we handle personal information.
What Beer Appear provides
- A menu guests open by tapping your NFC tags, and checkout with Apple Pay, Google Pay or a card.
- Ordering for pickup at the bar or delivery to a spot, with optional tabs.
- The bar station app your staff use to work orders, and a dashboard for your menu, zones, tags, staff, rules, tips and history.
- A connection to Stripe so guests' payments go to your account.
We provide the software only. We don't sell drinks, employ your staff or handle your guests' money.
Your bar is the seller
- You set your menu and prices, make and serve every order, and are responsible for what you serve.
- You hold, and keep in force, every licence and permit you need to sell alcohol where your bar is, and you follow the laws that apply to your bar.
- You're the merchant. Your bar's name appears on guests' card statements, and guests' questions about an order go to you first.
- Refunds are your decision. A manager or owner can refund an order from Beer Appear, and the money goes back to how the guest paid.
Alcohol, age and responsible service
Guests order and pay from their phones, so nobody checks their ID when they pay. That's why Beer Appear is only for bars that check ID at the door.
- You'll keep app ordering on only while your bar checks the ID of everyone who comes in and nobody under the legal drinking age is inside. You confirm this when you set up your bar, and staff confirm it on a bar station each night before app orders open.
- On any night that isn't true (an 18+ night, an all-ages show, a wristband event), you'll keep app orders off.
- You and your staff follow responsible service laws. You may check a guest's ID at pickup, and you'll refuse service to anyone who is under age or who shouldn't be served more. If you cancel a paid order, refund the guest.
- You set your own limits in Beer Appear, such as ordering hours, drinks per order and alcoholic drinks per guest. These help, but they don't replace your staff's judgement or your legal duties.
Payments, payouts and fees
- Stripe. To take orders you connect a Stripe account, new or existing, and agree to Stripe's Connected Account Agreement. Stripe processes guests' payments and pays out to your bank on its schedule. Stripe charges its own processing fees.
- Our fee. [2%] of each payment a guest makes, not counting the tip. It's taken automatically from each payment through Stripe, so there's nothing to invoice.
- Refunds. When you refund an order, in full or in part, we refund our fee on the refunded amount.
- Chargebacks. If a guest disputes a payment with their bank, the dispute is with your bar as the merchant. Stripe may hold the amount and charge a dispute fee, and you respond through Beer Appear or Stripe.
- Changes to our fee. We'll tell you at least [30] days before we change it. The new fee applies only to orders placed after it starts.
Tax
You choose the tax rates Beer Appear adds at checkout, and confirm them before guests can order. We suggest rates for your area as a starting point, but you're responsible for charging the right tax and paying it to the authorities.
Tips
Tips are paid to your Stripe account with each order, and Beer Appear takes no fee on them. You're responsible for paying tips to your staff as the law requires. The Tips page works out each person's share using the rules you set. It's a tool to help you, not payroll or legal advice.
Your team
- Owners add staff and choose their roles. Each person has their own account and PIN, and accepts the staff terms before they first use Beer Appear for your bar.
- You're responsible for what your staff do in Beer Appear for your bar, including refunds and cancellations.
- Remove people's access when they stop working for you, and change a PIN if it might be known to someone else.
- Staff aren't our employees or agents, and nothing in this agreement makes them so.
Tags and equipment
- You provide the iPads, tablets or computers for your bar stations and the NFC tags, and you keep tags in the spots they're set up for.
- Each zone only takes orders while a bar station covering it is online, so keep them charged and connected while app ordering is on.
- Tell us, or retire the tag in Beer Appear, if a tag goes missing or looks tampered with.
Guests' information
Beer Appear shows you what you need to serve guests: their name, where they ordered from, what they ordered, their note and tip, and their tab if they open one.
- Use it only to serve orders, handle refunds and tabs, run your bar's records, and as the law requires.
- Don't use it to market to guests or contact them for anything other than their order, unless they've separately agreed to it.
- Keep it secure, and tell us promptly if you think it's been accessed by someone who shouldn't have it.
[A lawyer should set out each party's role under data protection law (for example, whether the bar and Beer Appear are each a controller), and add any terms that law requires.]
Using Beer Appear fairly
You agree not to:
- take orders or payments through Beer Appear for anything other than what your bar sells there;
- place test or fake orders with real cards, or move money through Beer Appear for someone else;
- copy, resell or reverse-engineer Beer Appear, or get around its limits or security;
- use it for anything unlawful.
Ending this agreement
- There's no minimum term, including during a pilot. You can stop using Beer Appear at any time. To close your bar's account, email us.
- We can end this agreement with [30] days' notice.
- We can pause your bar's app ordering, or end this agreement straight away, if you seriously break it (for example, app orders on a night your bar isn't checking ID at the door), if your licence lapses, or to prevent fraud or harm.
- Fees on orders placed before the end still apply, and you remain responsible for refunds and chargebacks on those orders.
Our service
We work to keep Beer Appear running, but it may sometimes be unavailable, for example during maintenance or if your internet connection drops. When it's down, take orders at the bar as usual. We may change or improve features, and we'll give you notice of changes that significantly affect how your bar uses Beer Appear.
The Beer Appear apps, name, logo and designs belong to us. Your menu, logo and photos stay yours. You let us use them to run Beer Appear for your bar, and, if you agree, to show your bar as a Beer Appear venue.
Liability and indemnity
[To be written by a lawyer for your jurisdiction. It usually covers: the service is provided "as is"; Beer Appear isn't responsible for the bar's products, service or compliance with alcohol laws; the bar indemnifies Beer Appear against claims arising from the drinks it serves and how it serves them (including claims under dram shop or liquor liability laws); a cap on each party's liability; and whether the bar must carry liquor liability insurance.]
Disputes and governing law
If there's a problem, email us at [support email] and we'll try to sort it out first.
This agreement is governed by the laws of [jurisdiction]. [Courts or dispute resolution process.]
Changes to this agreement
If we change this agreement, we'll update the version and date at the top and tell your bar's owners at least [30] days before a significant change takes effect. Beer Appear will ask an owner to accept the new version. Until they do, your bar can't take app orders.
